J-1 physician job loss and employer changes

First distinguish training from waiver employment

A physician whose J-1 training ends early faces a different situation from a physician working in H-1B status after a waiver. Identify your actual status, the type of notice received and the relevant dates before treating any online description as your answer.

Contact your immigration counsel promptly. If the issue concerns J-1 training, also contact your training program and sponsor. A future job offer cannot repair an interrupted status by itself.

If a training program ends

Ask the program and sponsor to explain the effect of the event on your authorized activity and records. Intealth distinguishes normal program completion from termination; its guidance says the normal completion grace period does not apply to termination.

Do not assume that a generic J-1 or H-1B grace-period article covers your circumstances. Avoid starting work or arranging international travel until qualified counsel has reviewed the relevant status questions.

If employment changes during waiver service

USCIS explains that extenuating circumstances can be considered when a Conrad 30 physician needs to leave the original employer before completing the required service. A facility closure is one example. The review depends on the facts and documentation of the case.

A replacement employer may need to file a new employment petition and establish the relevant site eligibility. A physician should coordinate the state and federal requirements with counsel. A new offer is not a waiver-service transfer approval.

Prepare a clear factual record

Keep records you are authorized to retain and share them through your counsel’s chosen process. A concise timeline helps the advisers understand what changed without exposing unnecessary private information.

  • Your current status and the start and end dates in the relevant notices.
  • The waiver and employment petition decisions, if applicable.
  • The employment agreement and the worksite named in the approved case.
  • The reason for the interruption and related employer communications.
  • The service already completed and the details of any proposed replacement role.
